Asetek is likely having a victory dance after the decision made by a jury in the District court for California. The end result is that Asetek was ruled in its favour that Coolermaster infringed upon two of Asetek’s lawsuits for closed-loop liquid coolers.
The lawsuit was filed by Asetek against CMI (then known as Cooler Master USA, Inc), involving U.S. patent No. 8,240,362 and later U.S. Patent No. 8,245,764 when Seidon series was launched. Asetek also had a lawsuit against Swiftech of which Swiftech decided to pull off its products– the H220 and H240 rather than having legal fist-fights. CoolIT also faced issues with Asetek. There was also a case against a company called Asia Vital Components.
As an end result, Coolermaster now needs to pay $404,941 based on a calculation for royalty of 14.5% for sales since 2012. As one would expect, Asetek seemed happy. André Sloth Eriksen, Founder and CEO of Asetek said,“Although it is frustrating to have spent significant time and resources in a courtroom, it is rewarding to be vindicated in this way”. He continued,“Seen in the perspective of our future growth plans, especially in the data center segment, we cannot underestimate the significance of a solid portfolio of patents.”
The present and future for Coolermaster AIO liquid coolers at the very least in United States is unknown. Currently, Asetek submitted an injunction that Coolermaster must stop selling these liquid coolers This may affect Seidon, Nepton and the Glacier series sales over there, but may (or may not) affect sales in other countries. Though it should be noted that those in United States who wanted to purchase Swiftech coolers were able to do so via online stores in Canada. Eventually, Swiftech came up with a patent troll-proof designs H140X, H220X and H240X.
